Conditions d'utilisation du site Web
1. About LTYM
Living To Your Max (“LTYM,” “we,” “us,” or “our”) is a human development institute offering educational content, structured programs, coaching or accompaniment, workshops, speaking, and experiential immersions through a Body · Mind · Spirit framework.
The website is operated by Living To Your Max (LTYM), located at Montréal, Québec, Canada.
2. Website purpose and scope
The website provides general information about LTYM, its ideas, services, facilitators, events, and educational resources. Website content is not individualized advice and does not create a coach-client, therapist-client, fiduciary, employment, partnership, or other professional relationship.
Paid services are governed by the specific agreement or terms accepted during registration. If these Website Terms conflict with a signed service agreement, the signed service agreement governs the paid service.
3. Educational and professional-boundary disclaimer
LTYM content may discuss psychology, human behaviour, nervous-system regulation, relationships, leadership, health-related habits, meaning, values, spirituality, and personal development. It is provided for general educational and informational purposes.
LTYM does not use this website to diagnose or treat a medical or mental-health condition, provide psychotherapy, replace medical care, provide legal or financial advice, or provide emergency services. Users remain responsible for obtaining qualified professional support when appropriate.
Anyone facing an urgent medical, safety, or mental-health emergency should contact local emergency services or an appropriate regulated professional rather than rely on the website.
4. Eligibility
The website is intended for adults. A person under the age of majority may use publicly available educational content only with the involvement and permission of a parent or legal guardian. Paid services are limited to adults unless LTYM publishes a youth-specific offering with a separate guardian agreement.
5. Intellectual property
The website and its original text, frameworks, names, graphics, videos, audio, course descriptions, worksheets, photographs, designs, branding, and other materials are owned by or licensed to LTYM and are protected by applicable intellectual-property laws.
LTYM grants the user a limited, revocable, non-exclusive, non-transferable licence to access the website for personal, non-commercial use. No ownership is transferred.
Without prior written permission, users may not reproduce, distribute, sell, license, scrape, republish, modify, create derivative commercial products from, remove ownership notices from, or use LTYM material to train or populate a competing product, course, model, database, or service.
6. Permitted sharing
Users may share a normal link to a publicly accessible webpage or social-media post. Brief quotation for commentary, review, or education must include appropriate attribution and remain within applicable law. This permission does not extend to paid materials, full transcripts, downloadable resources, or members-only content.
7. Accounts and security
Where the website permits account creation, the user must provide accurate information, protect account credentials, and promptly notify LTYM of suspected unauthorized access. Accounts are personal and may not be sold, transferred, or shared.
LTYM may suspend or terminate an account used fraudulently, unlawfully, abusively, or in breach of applicable service terms.
8. Prohibited conduct
Users must not interfere with website security or operation; introduce malicious code; attempt unauthorized access; impersonate another person; harvest personal information; submit unlawful, infringing, deceptive, discriminatory, threatening, or harassing content; use automated extraction in a manner that burdens the service; or use the website to market competing services without permission.
9. User submissions and communications
When a user sends a general inquiry, application, testimonial, comment, or other submission, the user represents that it is accurate, lawful, and does not violate another person’s rights. Personal information is handled under the Privacy and Cookie Policy.
LTYM is not required to treat unsolicited business ideas, program concepts, or creative proposals as confidential unless a separate written confidentiality agreement has been signed.
10. Third-party platforms and links
The website may link to or integrate third-party services such as Wix, payment processors, video-conferencing tools, social platforms, maps, forms, calendars, analytics, or external resources. Their services are governed by their own terms and privacy practices.
LTYM does not control third-party availability, security, content, or business practices and does not endorse every statement appearing on a linked website.
11. Availability and changes
LTYM may maintain, change, suspend, or discontinue website features and may correct errors or update content. LTYM does not promise uninterrupted or error-free availability.
Program descriptions, schedules, prices, facilitators, and availability may change. A completed purchase remains governed by the contract provided for that purchase.
12. No guarantee of outcomes
Human development depends on many factors, including participation, context, readiness, health, relationships, environment, and decisions outside LTYM’s control. Testimonials and examples illustrate individual experiences and do not guarantee comparable results.
13. Disclaimer of warranties
To the fullest extent permitted by applicable law, the website and free content are provided “as available” without warranties beyond those that cannot legally be excluded. LTYM does not warrant that website information will be complete, suitable for every person, or free from every technical defect.
14. Limitation of liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot be excluded for bodily or moral injury under Quebec law.
Subject to mandatory law, LTYM is not responsible for indirect or consequential economic loss arising solely from use of, inability to use, or reliance on free website content.
15. Privacy and cookies
LTYM’s collection, use, communication, retention, and protection of personal information are described in the Privacy and Cookie Policy below, which forms part of the website framework.
16. Governing law and disputes
These Terms are governed by the laws applicable in Quebec and the federal laws of Canada applicable there. Any mandatory consumer right or jurisdiction rule continues to apply.
Before starting formal proceedings, the user and LTYM are encouraged to send a written description of the issue and attempt a good-faith resolution.
17. Changes to these Terms
LTYM may update these Terms prospectively. The effective date and version will be displayed. Material changes affecting a paid relationship will be handled under the applicable paid-service agreement rather than imposed retroactively without lawful notice or consent.

6. Consent and other lawful authority
LTYM will seek clear consent where required and will identify the relevant purposes. Consent may be withdrawn subject to legal and contractual restrictions and reasonable notice. Withdrawal may prevent LTYM from providing a service that genuinely requires the information.
LTYM will not bundle optional promotional media consent with necessary service consent. Sensitive information should be requested only when necessary and with an appropriate level of clarity.
7. Automated tools and AI-assisted processing
LTYM may use software to organize applications, schedule communications, transcribe with consent, or assist in drafting educational or integration materials. Before using a tool with participant content, LTYM must evaluate necessity, provider terms, retention, access, location, and security.
LTYM will disclose any decision made exclusively through automated processing when Quebec law requires disclosure. LTYM should not place highly sensitive coaching, relationship, or health content into a general-purpose AI system unless the practice has been approved, transparently disclosed, appropriately contracted, and protected.
8. Service providers and communications
LTYM may provide limited information to service providers acting for purposes such as website hosting, payment processing, email delivery, forms, scheduling, video conferencing, cloud storage, accounting, analytics, customer support, event logistics, legal services, insurance, and security. 9. Information outside Quebec
Some providers may store or process information outside Quebec or Canada. Before communicating personal information outside Quebec, LTYM should conduct the assessment required by applicable Quebec law and use appropriate contractual protections. Foreign authorities may access information under laws applicable where it is processed.

Users can manage non-essential cookies through the site’s consent tool and browser settings, although some functions may be affected.
14. Marketing communications
LTYM sends promotional electronic messages only with consent or another lawful basis. Each marketing email will include an unsubscribe mechanism. Service messages, invoices, safety notices, and contractual communications are not marketing and may still be sent where necessary.
15. Children and minors
LTYM’s general services are designed for adults. LTYM does not knowingly collect personal information from a child for a paid service without a youth-specific process and required parental or guardian authorization. If such information is collected unintentionally, the privacy officer should be contacted.
16. Recordings, photographs, and testimonials
Promotional use requires a separate and specific media authorization. Operational recordings of online sessions, if any, require advance disclosure concerning purpose, audience, access, and retention. Participants must not record other participants without express permission.

Conditions générales du participant principal
1. Parties and contract documents
The service provider is Living To Your Max (LTYM), operating as Living To Your Max (“LTYM”). The “Participant” is the person named in the registration or accepted application. The contract consists of: (a) the offer description and checkout information; (b) these Master Participant Terms; (c) the applicable addendum; (d) the Code of Conduct; and (e) any written schedule or informed-consent form expressly incorporated into the contract.
2. French-language process
Where Quebec law requires a predetermined contract and related documents to be drawn up and remitted in French, LTYM will provide the French version before the Participant expressly chooses to be bound by another language version. The checkout or signature process must record that choice.
3. Eligibility and truthful information
Unless a specific offering states otherwise, Participants must be at least 18 years old and legally capable of contracting. The Participant will provide accurate registration, payment, contact, accessibility, and safety information and will promptly update material changes.
4. Nature of LTYM services
LTYM is a human development institute. Its services develop capacity, skill, and coherence through education, structured practice, coaching or accompaniment, group learning, and experiential immersion across Self-Mastery, Relational Mastery, Leadership Mastery, and Experiential Immersion. Activities may address the Body · Mind · Spirit axis through nervous-system awareness, cognition, behaviour, communication, relationships, leadership, values, meaning, purpose, connection, and embodied practice.
5. Not medical care, psychotherapy, diagnosis, or emergency service
Unless a separately identified regulated professional is expressly engaged within their authorized scope, LTYM services are not medical care, psychotherapy, psychological diagnosis, nutritional treatment, legal advice, or another regulated professional service. LTYM does not diagnose mental disorders, prescribe treatment, or provide crisis or emergency response.
The Participant remains responsible for seeking appropriate regulated care. LTYM may recommend pausing participation or obtaining professional support where an issue exceeds the service scope or where continued participation appears unsuitable.
6. Participant agency, consent, and responsibility
-
Participation, disclosure, and practice are voluntary except for basic administrative and safety requirements.
-
The Participant may decline or pause an exercise and may ask for clarification or an alternative.
-
The Participant is responsible for personal decisions, implementation, boundaries, and obtaining appropriate professional advice.
-
The Participant will not participate while impaired or in a state that makes participation unsafe.
-
The Participant will disclose material limitations reasonably necessary for safe participation, while LTYM will avoid requesting unnecessary private information.
7. No guaranteed outcome
LTYM does not guarantee a personal, relational, health, leadership, business, emotional, spiritual, or financial result. Outcomes depend on factors outside LTYM’s control. Examples and testimonials are not promises.
8. Group confidentiality and its limits
LTYM will establish confidentiality expectations and will not intentionally disclose participant content except as described in the Privacy Policy, the contract, or applicable law. Each Participant must protect the identity, stories, images, contact information, and contributions of other participants.
Because LTYM cannot physically control every participant, it cannot guarantee that another participant will honour confidentiality. A Participant should disclose thoughtfully and avoid sharing information that belongs to an absent third party unless necessary and appropriate.
9. Conduct, dignity, and community safety
The Participant agrees to follow the Participant Code of Conduct and facilitator instructions reasonably connected to safety, consent, learning conditions, venue rules, privacy, and lawful operation. LTYM may intervene, restrict participation, or remove a person for serious or repeated misconduct.
10. Registration and acceptance
Registration is complete only when LTYM confirms acceptance and required payment. Some services require an application or suitability conversation. LTYM may decline an application for legitimate program-fit, capacity, safety, conflict, or operational reasons, subject to applicable law.
11. Price, taxes, and payment
-
The price, currency, taxes, deposit, instalments, and included services appear in the offer and order confirmation.
-
The Participant authorizes the selected payment method for agreed charges.
-
Payment plans are schedules for paying the full contractual price and are not month-to-month subscriptions unless expressly stated.
-
A failed payment must be corrected promptly. LTYM may pause access after reasonable notice where payment remains overdue.
-
The Participant must contact LTYM before initiating a chargeback so that a billing or service concern can be reviewed, without limiting statutory chargeback rights.
12. Participant cancellation and termination
The applicable addendum states the commercial cancellation rules. Regardless of those rules, any mandatory right under the Consumer Protection Act, Civil Code of Québec, or other applicable law continues to apply.
Where a service contract may legally be terminated, LTYM may retain or claim only the value of services already provided and other amounts or damages permitted by law. LTYM will not characterize every payment as non-refundable if the law requires a different result.
13. Missed sessions, no-shows, and unused benefits
A missed live session, coaching appointment, event, or included benefit is handled under the applicable addendum. Unless law or the addendum provides otherwise, LTYM is not required to recreate a live group experience for a person who does not attend.
14. LTYM changes, postponement, and cancellation
LTYM may make reasonable changes to timing, sequence, venue, platform, facilitator, or activity where necessary to preserve quality, safety, accessibility, or operation, provided the essential nature of the purchased service is not materially reduced without an appropriate remedy.
If LTYM cancels an offering and does not provide a substantially equivalent replacement accepted by the Participant, LTYM will refund the amount paid for the cancelled portion, subject to mandatory law. The applicable addendum addresses non-LTYM travel and third-party expenses.
15. Force majeure and events beyond reasonable control
Neither party is responsible for delay caused by circumstances beyond reasonable control, such as severe weather, public-health restrictions, transportation disruption, venue closure, utility or platform outage, natural disaster, labour disruption, government action, or facilitator illness. LTYM will act reasonably to reschedule, adapt, credit, or refund affected services according to the circumstances and mandatory law.
16. Technology and third-party services
Online components may require internet access, compatible equipment, email, and third-party platforms. The Participant is responsible for ordinary equipment and connectivity unless the offer states otherwise. LTYM is not responsible for a participant’s local technical problem but will make reasonable efforts concerning problems within LTYM’s control.
17. Intellectual property and personal-use licence
LTYM retains all rights in its frameworks, curriculum, recordings, workbooks, exercises, designs, presentations, prompts, names, methods, and materials. After full payment, the Participant receives a limited, non-exclusive, non-transferable, revocable licence to use provided materials for personal learning and application.
-
No sharing login credentials or distributing paid materials.
-
No recording sessions without express written permission.
-
No resale, commercial training, publication, uploading, or creation of a competing derivative program from LTYM materials.
-
The Participant retains ownership of original content they create, while granting LTYM only the permissions needed to deliver the service.
18. Recordings
LTYM will disclose before an offering whether sessions are recorded, the purpose, who can access them, and the access period. A Participant who does not wish to appear should use available privacy options or contact LTYM before the session. Promotional recording requires separate media consent.
19. Feedback and testimonials
Operational feedback may be used internally in de-identified form. Public use of an identifiable testimonial, image, voice, or story requires specific permission. Consent may be withdrawn prospectively, but LTYM may not be able to retrieve materials already lawfully distributed or printed.
20. Privacy
Personal information is handled under the Privacy and Cookie Policy and applicable law. Separate health, emergency, and media forms are used where appropriate. The Participant must not collect, copy, or misuse other participants’ personal information.
21. Safety and assumption of ordinary risks
Some experiential practices may involve movement, emotional reflection, interpersonal exercises, outdoor conditions, travel, or other disclosed risks. The Participant agrees to review relevant information, ask questions, follow reasonable safety instructions, stay within personal capacity, and stop when needed.
Nothing in this contract excludes or limits liability where prohibited by law. Acknowledgment of risk does not waive rights that cannot lawfully be waived.
22. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect or consequential economic loss that was not reasonably foreseeable from a breach. This clause does not exclude or limit liability for bodily or moral injury, intentional or gross fault, or any liability that applicable law prohibits the parties from excluding or limiting.
23. Participant responsibility for third-party loss
The Participant is responsible for loss directly caused by their unlawful conduct, deliberate misconduct, infringement of intellectual-property rights, unauthorized recording or disclosure, or damage to property, subject to applicable law. This is not an obligation to indemnify LTYM for LTYM’s own fault.
24. Suspension or removal
LTYM may immediately pause or remove a Participant where reasonably necessary to protect safety, consent, confidentiality, property, legal compliance, or the learning environment. Where the issue can be corrected, LTYM may provide notice and an opportunity to correct it. Refund consequences depend on the circumstances, the service already provided, committed costs, and applicable law.
25. Complaints and good-faith resolution
-
Contact LTYM at info@livingtoyourmax.com with the participant name, offering, relevant facts, and desired resolution.
-
LTYM will acknowledge and review the concern, seek relevant information, and respond within a reasonable period.
-
The parties will attempt a direct, good-faith resolution before litigation, without delaying a mandatory limitation period or consumer remedy.
26. Governing law
The contract is governed by Quebec law and applicable federal law. Any mandatory consumer-protection, language, privacy, jurisdiction, and procedural right continues to apply.
